Is smoking allowed on the beach in Barcelona? Rules and fines

It's one of the most common questions from people visiting Barcelona in summer: can you smoke on the beach? The short answer is no, neither tobacco nor, of course, cannabis. But the rules and fines are different in each case, so we'll explain.
Smoking: banned on all beaches in Barcelona
Since July 2022, the municipal bylaw has banned smoking tobacco on all of the city's beaches, from Sant Sebastià to Llevant. The fine for breaking the rule is 30 euros. Beach bars (chiringuitos) set up on the sand are exempt from this ban.
What about vaping?
The City Council also attempted to ban vaping on the beach, but in 2025 the High Court of Justice of Catalonia struck down that part of the by-law. Today, vaping nicotine on the beach is not penalised under the by-law. This does not change anything with regard to cannabis: vaping it in public remains prohibited.
Cannabis on the beach: the fine is much higher
The beach is a public space, and in Spain consuming or carrying cannabis in public is penalised under the Organic Law 4/2015 on Public Safety. It is considered a serious offence, with fines that start at 601 euros and can be considerably higher. The police can also confiscate whatever you are carrying.
- It doesn’t matter whether it’s a joint, a vape or edibles: what is punishable is consumption or possession in a public place.
- It doesn’t matter whether it’s a small amount or for personal consumption.
- If the joint contains tobacco, you may also face a local authority fine.
There is a strong police presence on Barcelona’s beaches during the high season, particularly at Barceloneta, Nova Icària, Bogatell and Mar Bella.
Where it can be consumed
In Spain, cannabis consumption by an adult in a private space is not penalised. That is why cannabis clubs exist: private associations where adult members consume inside the premises, away from public spaces. We explain it in more detail in whether marijuana consumption in Barcelona is legal or illegal.
Tips for a hassle-free day at the beach
- Do not carry cannabis with you on the beach or on your way there.
- Be careful when mixing alcohol, sun and cannabis: dehydration and drops in blood pressure are more likely.
- If you have been drinking, do not go for a swim if you are not feeling well, and always pay attention to the flags.
- Don’t buy anything from street vendors: not only is it illegal, but you don’t know what you’re getting.
Frequently asked questions
Can I smoke tobacco at the beach bar?
The beach bars on the sand are exempt from the by-law’s ban, but each establishment may have its own rules.
Can I be fined for carrying cannabis even if I’m not smoking it?
Yes. Possession in a public place is also an offence, even if you are not using it at that moment.
Are the rules the same on other beaches in Catalonia?
Not always: the ban on smoking varies from one local authority to another. What is the same throughout Spain, however, is the penalty for cannabis use in public places.
